By accessing or using our websites at outofyourhouse.com and outofmyhouse.com (together, the "Site"), you agree to be bound by these Terms of Service ("Terms"), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. These Terms constitute a legally binding agreement between you and Out of Your House ("we," "us," or "our"). Both domains are owned and operated by us, and these Terms apply equally to each.

If you do not agree with any of these Terms, you are prohibited from using or accessing the Site. Your continued use of the Site following the posting of any changes to these Terms constitutes acceptance of those changes.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. It is your responsibility to review these Terms periodically for updates.

The Site helps homeowners in Temecula, Murrieta, Winchester, French Valley, and surrounding Southwest Riverside County communities sell their homes. Two paths are available:

  • Cash Sale — We work with a network of vetted real estate investors who purchase homes for cash, as-is, on the seller's timeline. When you request an offer through the Site, we evaluate your property and present a no-obligation cash offer.
  • Agent-Assisted Sale — Where a listing is the better path, help is provided through Damian Gerry Realty Group, a licensed California real estate brokerage specializing in Temecula, Murrieta, Winchester, French Valley, and surrounding areas, which advises on the go-to-market strategy — off-market or on the MLS — and can represent the transaction.

Requesting an offer or a consultation through the Site is free and carries no obligation to sell. Real estate brokerage services are provided only by licensed professionals; we do not provide brokerage services except through licensed partners.

Any cash offer, estimate, or price range communicated through the Site, by email, by phone, or by text is an invitation to negotiate — not a binding commitment by either party. No party is obligated to buy or sell until a written purchase agreement is signed by both the buyer and the seller.

Offers are based on the information you provide and on market conditions at the time; they may be revised or withdrawn following a property inspection, a title review, or a material change in the information available to us. Stated timelines (such as offer turnaround and closing windows) are good-faith operational targets, not guarantees.

  • Reverse Engineer — Attempt to reverse engineer, decompile, or otherwise discover the source code, underlying algorithms, or infrastructure of the Site.
  • Misrepresent Identity — Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity, including Out of Your House or Damian Gerry Realty Group.
  • Interfere with Operations — Attempt to interfere with, compromise, or disrupt the Site's servers, networks, or infrastructure, including transmitting viruses, malware, or other malicious code.
  • Engage in Illegal Activity — Use the Site for any purpose that is unlawful, fraudulent, or prohibited by these Terms.
  • Reproduce or Distribute — Copy, republish, or transmit content from the Site without our prior written permission, except as expressly permitted by these Terms.
  • Frame or Mirror — Frame, mirror, or incorporate any part of the Site into any other website, application, or service without our prior written consent.

We reserve the right to terminate or restrict your access to the Site at our sole discretion, without notice, for any conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

The Site and all content, materials, information, services, and products available through the Site are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

To the fullest extent permitted by applicable law, Out of Your House disclaims all warranties, express or implied, including but not limited to:

  • Implied Warranties — Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
  • Accuracy and Completeness — Any warranty that content on the Site — including market commentary, guides, and calculator output — is accurate, complete, reliable, current, or error-free.
  • Availability — Any warranty that the Site will be uninterrupted, timely, secure, or free from viruses or other harmful components.
  • Results — Any warranty regarding the results of using the Site, including that you will receive an offer, a particular offer amount, or a completed sale.

No advice or information, whether oral or written, obtained by you from us or through the Site shall create any warranty not expressly stated in these Terms.

To the fullest extent permitted by applicable law, Out of Your House, including its officers, employees, agents, affiliates, partners, successors, and assigns, shall not be liable to you or any third party for any of the following:

  • Indirect Damages — Any indirect, incidental, special, consequential, exemplary, or punitive damages, regardless of the cause of action or theory of liability.
  • Specific Losses — Any loss of profits, revenue, data, goodwill, business opportunity, or anticipated savings, whether direct or indirect.
  • Content-Related Losses — Any damages arising from your reliance on any content, estimate, or materials available on or through the Site.
  • Access Issues — Any damages arising from your inability to access or use the Site, including any interruption, suspension, or termination.
  • Third-Party Conduct — Any damages arising from the conduct or content of any third party on or related to the Site.

These limitations apply whether the alleged liability is based on contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages. For clarity, this section governs your use of the Site; the rights and obligations of the parties to a signed purchase agreement or listing agreement are governed by that agreement.

In no event shall our total aggregate liability to you for all claims arising out of or relating to the use of or inability to use the Site exceed the amount you have paid to us in the twelve (12) months preceding the event giving rise to the claim, or one hundred dollars ($100.00), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms, or the breach, termination, enforcement, interpretation, or validity thereof, shall be subject to the exclusive jurisdiction of the state and federal courts located in Riverside County, California.

You irrevocably consent to the personal jurisdiction and venue of such courts and waive any objection to the laying of venue of any action, suit, or proceeding in such courts, including any claim that such a proceeding has been brought in an inconvenient forum.
